Mission of the BOA
The Board of Appeals is available for building requests that do not comply with the Town's Setback Codes but would create an undue hardship on the applicant if they were to abide by those codes. The BOA is here to hear why compliance would be a hardship and to determine if there are alternate solutions which would be in keeping with the harmony of the town.

A PUBLIC HEARING BEFORE THE BOARD OF APPEALS FOR THE TOWN OF NILES WILL BE HELD ON NOVEMBER 08, 2023, AT 7:00 PM, TO CONSIDER THE FOLLOWING APPLICATIONS: FILE NUMBER NV2023-4, BY DAVID SILVERBERG, FOR PROPERTY LOCATED AT 320 FIRE LANE 15, IN THE TOWN OF NILES. A VARIANCE OF SECTION 164.8.B OF THE BUILDING SETBACK LAW OF THE TOWN OF NILES IS REQUESTED TO ALLOW CONSTRUCTION OF A YEAR-ROUND RESIDENCE, CURRENT COTTAGE ON SITE TO BE DEMO’D, TO BE CLOSER THAN THE MINIMUM 15 FEET TO AN ADJACENT SIDE PROPERTY LINE OR REAR PROPERTY. ALSO, FOR CONSIDERATION WILL BE APPLICATION FILE NUMBER NV2023-5, BY ROBERT GALLASCH AND GAIL MORSE, FOR PROPERTY LOCATED AT 3453 WHITE ROAD, IN THE TOWN OF NILES. A VARIANCE OF SECTION 164.8.A OF THE BUILDING SETBACK LAW OF THE TOWN OF NILES IS REQUESTED TO ALLOW A 3-CAR GARAGE ADDITION TO BE BUILT OFF THE CURRENT HOUSE, IT WILL BE CLOSER THAN 75’ FROM THE CENTER LINE OF WHITE ROAD. THE ABOVE APPLICATIONS ARE OPEN FOR INSPECTION AT THE TOWN CLERK’S OFFICE IN NILES TOWN HALL IN NEW HOPE, NEW YORK. PERSONS WISHING TO APPEAR AT SUCH HEARING MAY DO SO IN PERSON OR BY ATTORNEY OR OTHER REPRESENTATIVE. COMMUNICATION IN WRITING IN RELATION THERETO MAY BE SENT TO THE BOARD OF APPEALS AT THE NILES TOWN HALL.
