Mission of the BOA
The Board of Appeals is available for building requests that do not comply with the Town's Setback Codes but would create an undue hardship on the applicant if they were to abide by those codes. The BOA is here to hear why compliance would be a hardship and to determine if there are alternate solutions which would be in keeping with the harmony of the town.

A PUBLIC HEARING BEFORE THE BOARD OF APPEALS FOR THE TOWN OF NILES WILL BE HELD ON DECEMBER 4, 2024, AT 6:00 PM, TO CONSIDER THE FOLLOWING APPLICATION: FILE NUMBER NV2024-3, BY JAMES HELMER, FOR PROPERTY LOCATED AT 75 WOODLOT LANDING, IN THE TOWN OF NILES. A VARIANCE OF SECTION 164-8.B OF THE BUILDING SETBACK LAW OF THE TOWN OF NILES IS REQUESTED TO ALLOW INSTALLATION OF A DECK WHICH WILL BE CLOSER THAN THE MINIMUM 15 FEET TO AN ADJACENT SIDE PROPERTY LINE OR REAR PROPERTY. THE ABOVE APPLICATION IS OPEN FOR INSPECTION AT THE TOWN CLERK’S OFFICE IN NILES TOWN HALL IN NEW HOPE, NEW YORK. PERSONS WISHING TO APPEAR AT SUCH HEARING MAY DO SO IN PERSON OR BY ATTORNEY OR OTHER REPRESENTATIVE. COMMUNICATION IN WRITING IN RELATION THERETO MAY BE SENT TO THE BOARD OF APPEALS AT THE NILES TOWN HALL.
